Signal Terms of Sale & Refund Policy

Spot Checks and buyer-funded Coverage Requests · Version 0.1.0 (DRAFT)

Draft — pending legal review
This policy has not been reviewed by outside counsel. It is a developer-actionable starting point and is not legal advice. A licensed U.S. attorney must finalize it — including state consumer-protection, money-transmission, and private-investigator licensing review — before launch.

Effective Date: as of the date you complete a purchase

These Terms of Sale ("Terms") govern your purchase of a Claimitt Signal "Spot Check" or a buyer-funded "Coverage Request" (each, a "Funded Assignment"). By completing a purchase, you agree to these Terms. These Terms supplement, and do not replace, the Claimitt Terms of Service and Privacy Policy.

1. What you are purchasing

1.1 A paid reporting assignment. A Funded Assignment is a request for original public-interest photos, video, and/or field observations captured from lawful public areas by an independent freelance contributor. You are paying to commission freelance reporting and to license the resulting content — not to retain an investigator or agent.

1.2 What it is not. A Funded Assignment is not an investigation, surveillance, background check, locate service, security service, or private-investigator service. Contributors are not law enforcement, emergency responders, or private investigators. You may not use Signal to obtain information about crimes or wrongs, to identify, locate, surveil, or track any person, to monitor private property or private conduct, or to gather evidence for a proceeding.

1.3 Best-effort, not guaranteed. Funded Assignments are offered to eligible independent contributors near the location. Acceptance and completion are not guaranteed and depend on contributor availability, weather, safety, and conditions on the ground.

2. Prohibited requests

You will not request, and Claimitt will not facilitate, any assignment that targets a specific individual; asks a contributor to enter private property or any non-public area; involves crime, violence, medical emergencies, minors, or graphic content; or seeks information about a person's identity, conduct, movements, or whereabouts. Claimitt's safe-category controls enforce these limits and Claimitt may decline and refund any request that violates them.

3. Pricing, fees, and payment

3.1 Amounts. The price shown at checkout includes the contributor payout and a Claimitt service fee, each itemized before you pay. For buyer-funded Coverage Requests, the total reflects the per-report payout multiplied by the number of reports requested, plus the service fee.

3.2 Processor. Payments are processed by our third-party payment processor (Stripe). Claimitt does not store full card details. Your purchase is also subject to the processor's terms.

3.3 Currency. All amounts are in U.S. Dollars. Funded Assignments run solely on the USD rail and never involve CLMIT or any platform token.

4. Fulfillment

Once paid, your assignment is offered to nearby eligible contributors for a limited window (the "Assignment Period") shown at checkout. A submission is "fulfilled" when a contributor's report is accepted under Claimitt's verification standards. For multi-report Coverage Requests, each report slot is fulfilled independently.

5. Refund policy

5.1 Unclaimed or unfulfilled assignments. If your assignment is not accepted by a contributor, or a report slot is not fulfilled, by the end of the Assignment Period, that amount is refunded automatically. For single-report Spot Checks this means a full refund; for multi-report Coverage Requests you are refunded for each unfulfilled report slot, proportional to the total you paid.

5.2 Timing. Automatic refunds are initiated by Claimitt after the Assignment Period ends. Refunds are returned to your original payment method and typically post within 5–10 business days, depending on your bank or card issuer. We do not control that posting time.

5.3 After fulfillment. Once a report slot is fulfilled (a submission is accepted), that portion of the assignment is complete and is not refundable, except (a) as required by applicable law, or (b) where the delivered content materially fails to meet the assignment's stated, lawful requirements — in which case Claimitt may, in its discretion, re-offer the assignment or issue a refund or credit.

5.4 Prohibited or cancelled requests. Requests Claimitt declines under Section 2, or that Claimitt cancels for safety, legal, or policy reasons, are refunded in full.

5.5 How to ask about a refund. If you believe a refund is owed and has not been issued, contact Claimitt support with your order reference. Initiating a chargeback before contacting support may delay resolution.

6. License to delivered content

On fulfillment, you receive a non-exclusive license to use the delivered content for your stated, lawful purpose (e.g., news, internal review, or the use described at checkout), subject to any restrictions shown with the assignment. You will not use delivered content to harass, surveil, stalk, or unlawfully identify or track any person. Contributors retain ownership of their work except as licensed; broader or exclusive rights, where available, are offered separately.

Unless the checkout flow or written license expressly grants download, rehosting, syndication, or exclusive rights, delivered content must be viewed, shared, and cited through Claimitt's native delivery links, embeds, previews, or licensed files. You may not remove watermarks, attribution, origin links, timestamps, metadata, or other copyright-management/provenance information, and you may not reupload delivered content as your own.

7. Disclaimers

Funded Assignments and delivered content are provided "as is." Claimitt does not warrant the accuracy, completeness, or fitness for any particular purpose of contributor submissions, and is not responsible for the acts or omissions of independent contributors. Claimitt is a neutral platform connecting requesters with independent freelance contributors.

8. Limitation of liability

To the maximum extent permitted by law, Claimitt's total liability arising from a Funded Assignment will not exceed the amount you paid for that assignment. Claimitt is not liable for indirect, incidental, or consequential damages.

9. Changes; governing law; contact

Claimitt may update these Terms prospectively; the version in effect at your time of purchase governs that purchase. Governing law, venue, and any dispute-resolution terms are as stated in the Claimitt Terms of Service. For questions or refund inquiries, contact Claimitt support.

END OF DRAFT — counsel to finalize, including consumer-protection, money-transmission, and PI-licensing review for each launch jurisdiction.
